NC General Statute 20-141.3 Unlawful Racing on Streets and Highways
If a person is guilty of prearranged racing, a person is guilty of a class 1 misdemeanor.
Law Enforcement can seize the vehicle and deliver the vehicle for sale by the New Hanover, Pender, or Brunswick County Sheriff’s Department.
The vehicle can be returned if one of the conditions is met under NC General Statute Section 20-141.3(g):
(1) If bond paid equal to double the value of the vehicle is posted,
(2)If the defendant is acquitted, or
(3) If the owner can prove they did not know that the vehicle was being used illegally. If convicted the vehicle would be sold at auction.
Also, a defendant’s license shall be revoked under NC General Staute 20-141.3(d).
